1. Please ensure that you have read these terms and conditions before purchasing your ticket to the Event. 2. By purchasing a Ticket, you agree to be bound by these terms and conditions. 3. You must abide by any additional policy, rule or terms and conditions set by the Event venue relating to attendees or visitors at their site. 4. Please do not purchase a Ticket if you do not agree with these terms and conditions. 5. Failure to abide by these terms and conditions may result in you being refused entry to the Event or being ejected from the Event without refund or reimbursement. 6. These terms and conditions may be subject to change. The terms and conditions that apply to your Ticket will be those in force at the time that you purchased your Ticket. 7. The following definitions apply: ‘Event’ means the Canberra Brick Show. ‘Force Majeure Event’ means event, circumstance, or situation outside of our reasonable control (including but not limited to any act of God, natural disaster, fire, flood, pandemic, council or government sanction or order, actions or decisions of police or other authorities, act of terrorism, war or industrial action. ‘Minimum Age’ means any minimum age imposed at law in respect of the purchase or use of certain goods and services from time to time. ‘PhotoID’ means photographic identification documents, being either a valid driver’s licence or other official Australian identification card, or an Australian or foreign passport. ‘Platforms’ means any website, social media pages, applications or channels owned or controlled by us. ‘Prohibited Items’ include, without limitation; alcohol; illicit drugs; knives; weapons; fireworks; explosives; glass; compressed gas containers; fires or open flames of any kind; political, religious, offensive or race-related banners, signs, slogans or materials; flares; air horns; sound amplifiers including loudhailers; toy guns or water pistols; smoke bombs and flag sticks; drones; dogs or other pets (except service animals); laser pointers; skateboards, roller blades, scooters or bicycles; or items that may interfere with the enjoyment, comfort or safety of other persons or security at the Event. ‘Ticket’ means an entry ticket for the Event. ‘We’, ‘us’, or ‘our’ means the organisers of the Canberra Brick Show. ‘You’ or ‘your’ means the person or persons who will use the Ticket for entry to the Event. Tickets 9. We will grant you entry to the Event upon presentation, for inspection, of a valid Ticket. Any person found without a valid Ticket may be refused entry or ejected from the Event and you will not be entitled to any refund or reimbursement. 10. Except where required by law or otherwise detailed in these terms and conditions, all Tickets are: a. not refundable; b. valid only for the specific Event for which they have been issued; c. valid only if payment has been made in full prior to entry; and d. valid only for the specific date, time and any other conditions stated on (or registered to) the Ticket. 11. Changes to Tickets: We may, at our sole discretion, permit the date and time of entry stated on (or registered to) your Ticket to be changed. You must contact us prior to the date and time stated on (or registered to) your Ticket. We may refuse entry to the Event if you are late and you may not be reimbursed or refunded for your Ticket in such circumstance. To contact us, please email clugevents@gmail.com. 12. Ticket Refunds: We will not provide a refund if you change your mind or forget to attend the Event. We may, at our sole discretion, provide a refund if there is a change to your personal circumstances. You must contact us prior to the date and time stated on (or registered to) your Ticket. To contact us, please email clugevents@gmail.com. 13. Tickets must be treated like cash. Tickets may be deemed invalid if: a. they are lost, stolen, destroyed, tampered with, defaced, or damaged so that we cannot verify the authenticity of the Ticket; or b. we reasonably suspect that fraud, scalping or other improper use has taken place. 14. Tickets may have your name printed on them or may be otherwise registered to your name. You are responsible for checking all information provided at the time of purchase is accurate and correct. We may check your Photo ID to ensure the name on your Photo ID matches the name on, or registered to, your Ticket. If the name on, or registered to, your Ticket does not match the name on your Photo ID, your Ticket may be invalid. The name on your Ticket, or the name to which your Ticket is registered, may be changed by contacting us. 15. Your Ticket grants you one entry to the Event. Subject to directions from Event staff, you may be permitted to temporarily leave the Event and to enter without being required to purchase a new Ticket. 16. By purchasing a ticket: a. you warrant that you are over the age of 18 and have the right and authority to enter into a binding contract with us and are not prohibited from doing so under any applicable laws, rules, and regulations; and b. if you are not 18 years or older, you warrant that your parent or guardian consent to your purchase of a ticket, agree to these terms and conditions, and undertake to be liable for the same on your behalf. c. if you are aged 13 years or younger, a parent or guardian must purchase your Ticket on your behalf. 17. Tickets to attend the VIP Event between 7:00pm and 9:30pm on Saturday 28 October 2023 will only be available to persons above the Minimum Age. 18. Tickets may not, without the prior written consent from us, be re-sold or offered for resale at a premium (including via online auction sites) or used for advertising, promotion or other commercial purposes (including but not limited to competitions and trade promotions) or to enhance the demand for other goods or services, either by the original purchaser or any subsequent holder. If a Ticket is sold or offered for resale or used in breach of this condition, the Ticket may be invalid and the holder of the ticket may be refused admission or ejected from the Event without a refund. 19. Any complimentary Tickets may not, without the prior consent of us in each instance, be sold, transferred or used by anyone other than the person whose name is on the Ticket or to which the Ticket is registered. 20. We may utilise third parties to process payments made by you. Any payments processed through a third party will be in accordance with the terms of that third party. You are responsible for making your own enquiries into the terms and conditions of the relevant third party. All enquiries or issues relating to processing of payments must be directed to the third party. In no event shall we be responsible or liable for any payments, processing issue, or error through a third party. 21. You warrant that you have the required authority to make any payments, including any required permissions or consents from any credit card holder or account holder if you are not the owner or holder of the credit card or account used for the payment. 22. Where refunds are granted, they may be made to the card or account from which the original purchase was made. Refunds may be less any booking fees or charges unless we are otherwise required to refund these in accordance with Australian Consumer Law. Consent to Search 23. You consent to a search of you and/or your possessions. This may be conducted at the time of entry or at other times if requested by us. Recording and Photography 24. Photos are encouraged and permitted only on the basis that images are only used for private and personal use. 25. Without our permission, the following is strictly prohibited whilst attending the Event: a. flash photography; b. filming and photography for a commercial purpose; and c. professional photography equipment (including, but not limited to tripods). 26. We shall determine, at our absolute discretion, whether photography equipment is considered to be professional photography equipment. 27. Subject to the above, personal digital cameras (including smartphones) are permitted. 28. We reserve the right to confiscate and/or delete any unauthorised or prohibited recording, film, photography, or content, and to eject from the Event any person contravening this clause. 29. You consent to your likeness, image, and voice in any audio recordings, audio-visual recordings (including CCTV footage), and photographs in connection to your attendance at the Event. Safety 30. In accordance with the Work Health and Safety Act 2011 (ACT), you are to: a. Take responsible care of your own health and safety b. Take reasonable care to ensure that you do not adversely affect the safety of others c. Comply with all instructions given by Event staff (including but not limited to security, bar, and traffic management personnel), and conveyed on signage or other notices, whilst attending the Event so far as you are reasonably able to. 31. You must take reasonable care when moving around the Event. You must move in an orderly fashion, in accordance with the directions of the Event personnel, and you must not do anything that may hinder, or prevent, the safe passage of other people. 32. We do not accept responsibility for the negligent acts or omissions of Ticket holders. 33. In the event of injury or illness at the Event, we may, at your sole expense, arrange medical treatment and/or emergency evacuation as deemed necessary or advisable (in our opinion) for your health and safety, or for the health and safety of other persons. 34. Children must be supervised by a parent or guardian at all times. It is the responsibility of the parent or guardian to make their own judgement as to the suitability of the Event for their child before making a booking. Refusal of Entry 35. We reserve the right to, and to authorise or instruct personnel to, refuse entry or eject any person from the Event that: a. fails to comply with these terms and conditions; b. appears to be unwell or is showing symptoms of a contagious disease; c. touches and/or causes damage to property, models or displays (including without limitation any artwork); d. engages in any illegal activity or behaviour or any activity or behaviour deemed in our absolute discretion to be unsafe, disorderly or antisocial, including without limitation being intoxicated or affected by alcohol or drugs; e. enters non-public or designated no access areas of the Event or areas of to which your Ticket does not permit access; or f. acts in a violent, threatening, inappropriate, abusive, aggressive, sexist, racist or discriminatory manner, or for any other reason at our absolute discretion. Prohibited Items 36. We may confiscate any Prohibited Items or any other items which we, at our absolute discretion, consider may be used in an illegal, unsafe, antisocial or offensive manner. Confiscated items may not be returned, replaced or reimbursed. 37. If you have any medical or mobility equipment necessary for your health that may otherwise be considered a Prohibited Item, please bring this to the attention of Event staff. Alcohol and Drugs 38. We may make available designated smoking areas at our sole discretion and subject to any rules or policies set by the Event venue. Smoking and/or vaping will only permitted in a designated smoking area. Any person found smoking (other than in a designated smoking area) may be ejected from the Event. 39. If you are found supplying, consuming or in possession of illicit drugs or illegal substances, you will be ejected from the Event and we may notify the police. 40. Between 7:30pm and 9:30pm on Saturday 28 October 2023 (‘designated times’) only, the consumption of alcohol is permitted. At other times, if you are found consuming or in possession of alcohol, you will be ejected from the Event. 41. If you become intoxicated, you will be ejected from the Event. 42. During designated times, you may be required to provide Photo ID to the satisfaction of Event and/or venue staff to verify that you are the Minimum Age. 43. You must not bring alcohol when attending the Event at designated times. Only alcohol purchased from the Event or from an authorised vendor may be consumed in permitted areas at the Event. You must be the Minimum Age or over to purchase and/or consume alcohol. 44. If you are found supplying or buying alcohol for any person under the Minimum Age you will be ejected from the Event and we may report your conduct to the police. Attire 45. Appropriate clothing and closed footwear must be worn at all times. Any person wearing high heels, studded clothing, or other clothing items (including umbrellas) which pose a safety threat or may otherwise cause offence, at our sole discretion, may be refused entry or ejected from the Event. Signage 46. You must not display any commercial, religious, political, or other signage at the Event without permission from us. Movement Around the Event 47. You should familiarise yourself with the layout of the Event, including the location of any emergency exits, to assist with moving around the Event safely in the event of an emergency. 48. We will endeavour to make the Event accessible for those using wheelchairs, mobility scooters or with disability; however you acknowledge that the venue may have pre-existing natural terrain or pre-existing structures and facilities, which in some cases may render it impossible, impractical, unsafe or contrary to building laws or regulations to make all areas of the Event accessible for all patrons. By purchasing a Ticket, you acknowledge and understand that some public areas of the Event may not be accessible by all patrons. If you have any concerns about the accessibility of the Event, please contact us prior to your Ticket purchase or entry to the Event for more information. Environment and Facilities 49. Please be respectful of the Event environment and place any litter in the recycle or other bins provided. You must not damage, improperly use, or tamper with any property or facility at the Event, or intentionally or recklessly cause any damage or interference to the area surrounding the Event venue. 50. When exiting the Event, you must remove all of your belongings, rubbish, and recycling. We will not be responsible for any of your property left at the Event and we may discard, sell or donate to charity any property left at the Event. Force Majeure Event 51. If we cannot provide the Event (in whole or in part) due to a Force Majeure Event, we may, at our sole discretion: a. Reschedule. We may reschedule the Event and allow you to redeem your Ticket for any rescheduled date(s) as advertised or otherwise notified to you. In these circumstances, we will continue to hold payment for your Ticket and you shall not be entitled to a refund unless you notify us that you cannot attend; b. Relocate. We may relocate the Event to an alternate venue or location. Where the new venue or location is significantly different to the original venue or location notified to you at the time of purchase, you may be entitled to a refund if you notify us that you cannot attend; or c. Cancel. If the Event is cancelled by us due to a Force Majeure Event, then we will grant you a refund (less any booking fees and charges). Refunds should be applied for within four (4) weeks from the announcement of cancellation. d. If only part of the Event is cancelled, significantly relocated, rescheduled, or otherwise significantly varied, we may offer you a pro-rata refund if it is reasonable to do so in the circumstances. Errors, Omissions and Disclaimers 52. We endeavour to take reasonable care to ensure that information and material published on our Platforms is free from errors and kept up to date, however we do not make any warranties in relation to the accuracy, currency, reliability or completeness of any content that is published on our Platforms, whether or not that content was published by us or third party users. We encourage you to make your own enquiries before using or relying on any information provided on any Platforms, and if you choose to do so, you do so at your own risk and we shall not be responsible for any errors, omissions, or claims for loss or damages arising from your use of or reliance on any information on any Platform. 53. Further, any opinions or views expressed on the Platforms do not necessarily reflect the official policy or position of us or our officers, employees, volunteers and agents. References to a product or service on Platforms should not be construed as an endorsement or recommendation of that product or service. 54. Platforms may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. We do not endorse any of these third party websites or the information, products or services that they provide. You interact with the third party websites at your own risk. 55. You acknowledge that no data transmission over the internet can be guaranteed as completely secure. We do not warrant and cannot ensure the security of information during transit over the internet. Accordingly, any information that you transmit to us is transmitted at your own risk. 56. Unless required by law, we are not responsible for any travel, accommodation, food, or other expense or costs that you may incur in connection to your attendance at the Event or as a result of any cancellation, relocation or rescheduling of the Event. You should carefully consider the refund and cancellation policies of travel, accommodation and other goods or service providers when making arrangements to attend the Event. You may also wish to consider taking out a relevant insurance policy to cover for any losses in the event of cancellation, rescheduling, loss, or relocation. 57. To the extent permissible by law, we make no warranties or representations regarding: a. the suitability of the Event (any photos used in connection with the promotion and marketing are illustrative only and should not be relied upon as an accurate description of the Event); and b. all information and materials provided through any Platforms. 58. All prices quoted are in Australian dollars. COVID-19 59. By purchasing a Ticket, or attending our Event, you warrant that to the best of your knowledge: a. you have the full right and authority to supply the name and phone number for everyone in your group, if requested by us, to enable COVID-19 contact tracing; b. you, and each person you are attending our Event with, do not have COVID-19, and are not awaiting test results for COVID-19, or otherwise have reason to suspect that you or they have contracted COVID-19; c. you, or a person you are attending our Event with, have been not been deemed a close contact of a confirmed COVID-19 case in the last seven (7) days and are not currently under any isolation orders either in the Australian Capital Territory or another jurisdiction; d. you, and each person you are attending our Event with, have not been directed to quarantine or self-isolate by a government representative or medical personnel; e. you, and each person you are attending our Event with, are not experiencing any symptoms of COVID-19 as published by the Australian Capital Territory Health Directorate from time to time, including but not limited to: • a cough; • fever; • shortness of breath; • sore throat; • sneezing and runny nose; • temporary loss of smell or taste; or • altered sense of taste 60. If any person cannot make the warranties above, they must not purchase a Ticket or attend our Event. 61. You acknowledge that we may collect personal information for the purposes of contact tracing and complying with COVID-19 related legislation, regulations and health orders. 62. You warrant that any personal information provided by you to us or our authorised agents is correct, true, and accurate. 63. You agree and acknowledge that we may need to make significant changes to the Event in response to COVID-19 and to comply with any legislation, regulation, health order or other government direction or recommendation in place to prevent the spread of COVID-19 (e.g. mandatory vaccination, mask-wearing) and that these changes may occur after you purchase your Ticket. 64. If you cannot redeem your Ticket for the Event because of a federal or state government law, regulation, or order which is in place for the purpose of preventing the spread of COVID-19 and that prohibits you from travelling from your ordinary place of residence to the Event, you will be entitled to a refund on the following conditions: a. You notify us and request a refund prior to the specific date and time of entry stated on (or registered to) your Ticket. b. We are satisfied that at the time of requesting the refund, there is a federal or state government law, regulation, or other order related to COVID-19 in place which would reasonably prevent you from travelling to the Event. Application of Laws 65. The terms and conditions shall be governed by and construed in accordance with the laws of the Australian Capital Territory, Australia and the parties irrevocably and unconditionally submit to the jurisdiction of the courts in that territory. Event Organisers 66. This Event is organised by the Canberra LEGO User Group Inc. This event is not affiliated with the LEGO Group. Lego and the LEGO logo are trademarks of The LEGO Group. 67.
